A letter to the NGOs by DDDS

Encouraging decisions taken by the central government

Shri Alok Kumar

To

All Participants of

‘Swasth Sabal Bharat Conclave’

Dear Sir / Madam,

It was a historic occasion when the NGOs working for Organ-Body Donation and other stakeholders in the health sector met in Delhi on 3 – 4 September 2022 and decided to initiate a ‘National Campaign for Body-Organs Donation’. The deliberations of the Conclave were communicated to the Govt of India.

The decisions and response of the Central Govt. in the recent past are encouraging.

They include:

  1. The Govt. has decided to do away with the domicile requirements for registration in the waiting list for organs. Now one can register for an organ anywhere in the country
  2. Some State Governments were charging a fee of Rs. 5000 to Rs. 10,000 for registration in the waiting list for organs. The Central Govt. has advised that no fee be charged from the patients for registration to receive organs for transplantation.
  3. Earlier, according to the NOTTO guidelines an end-stage organ failure patient above 65 years of age was not allowed for registering to receive the organ from deceased donors. With the improvement of healthcare in the Country, this age limit has been done away with by modifying the National Organs Transplantation Guidelines.
  4. Many delegates in the Dadhichi Conclave had pointed out that many states have devised their own methods for implementation of the Transplantation of Human Organs Act, 1994 and the protocols for receiving, storing and transplanting organs as also the protocols for cadavers’ donations. The variance in the said guidelines and rules caused confusion and difficulties in inter-state matters.

We are happy to convey that the Govt. is working on a ‘one nation one policy for organ donation’ to do away with these variations.

  1. A key step in this direction would be the centralised registration system of organ donors and recipients.
  2. The Govt is also in the process of preparing study material on organ donations for inducting in the school curriculum.

Warm Personal Regards.

Yours Sincerely

Alok Kumar, Sr. Advocate
